Terms and Conditions for EpiPilot
Welcome to EpiPilot, an AI-powered platform designed to enhance the management of emergencies, events, and errors within your organization. By accessing or using the EpiPilot platform, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully before using our services. If you do not agree with these Terms and Conditions, you must not use the platform.
1. Acceptance of Terms
By subscribing to and using EpiPilot, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as well as any other applicable policies referenced herein.
2. Service Description
EpiPilot is a subscription-based platform that provides automated event and event management services leveraging Artificial Intelligence. The platform is intended solely for internal use by subscribing institutions for the management of events and events. The platform is not intended for use in any other context, including but not limited to political, economic, or life-critical applications.
3. Permitted Use
The platform may only be used for the purpose of managing events and events within the subscribing institution.
Access to and use of the EpiPilot platform is limited to authorized users within the subscribing institution. Resale, sublicensing, distribution, or any form of third-party access is strictly prohibited without express written permission from the service provider.
The platform must not be used in any manner that violates applicable laws, regulations, or third-party rights.
4. Prohibited Use
The platform must not be used for any illegal activities, including but not limited to unauthorized surveillance, data manipulation, or activities that infringe on privacy rights or violate local, national, or international laws.
The platform may not be used for purposes that could result in political, economic, or life-threatening consequences.
5. Limitation of Liability
The service provider shall not be liable for any losses, damages, or adverse outcomes, including economic losses, material damages, or loss of life, arising from:
Misuse or unauthorized use of the platform.
Communication failures, technical interruptions, or service outages beyond the provider’s control.
Natural disasters, force majeure events, or any other circumstances outside the reasonable control of the service provider.
Decisions or actions taken by the client based on information or data generated by the platform.
6. Exclusion of Warranties
The EpiPilot platform is provided "as is" and "as available," without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
The service provider does not guarantee that the platform will be error-free, uninterrupted, or meet specific performance requirements.
7. Indemnification
The subscribing institution agrees to indemnify, defend, and hold harmless the service provider, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney’s fees, arising out of or connected with:
Misuse or unauthorized use of the platform.
Any breach of these Terms and Conditions by the subscribing institution.
Any violation of applicable laws, regulations, or third-party rights.
8. Compliance with Laws
The subscribing institution is responsible for ensuring that its use of the EpiPilot platform complies with all applicable laws, regulations, and industry standards. The service provider disclaims any liability arising from the client’s non-compliance.
9. Changes to the Terms and Conditions
The service provider reserves the right to modify these Terms and Conditions at any time. Any changes will be posted on this page, and your continued use of the platform constitutes acceptance of those changes.
10. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which the service provider is established, without regard to its conflict of law principles. Any disputes arising under these terms shall be resolved exclusively in the courts of that jurisdiction.
11. Force Majeure
If the performance of any service or obligation under this Agreement is prevented, restricted, delayed, or interfered with due to reasons such as acts of God, floods, lightning, severe weather, utility or communication failures beyond the control of the party, earthquakes, war, revolution, civil commotion, acts of public enemies, blockade, embargo, or any law, order, proclamation, regulation, ordinance, demand, or requirement with legal effect from any government or any judicial authority or representative of any such government (referred to as an 'event of Force Majeure'), then that party shall be excused from performing the affected obligations for the duration of the event of Force Majeure causing such non-performance.
However, certain conditions apply:
(i) The non-performing party must immediately notify the other party of the failure, inability, or delay.
(ii) The failure, inability, or delay could not have been prevented through the use of reasonable precautions.
(iii) The non-performing party cannot reasonably circumvent the failure, inability, or dely through the use of alternate sources, work-around plans, or other means.
As long as these circumstances prevail, the party whose performance is prevented, delayed, or hindered shall make all commercially reasonable efforts to resume performance without undue delay. Notwithstanding any contrary provisions in this Agreement, Dataworks 's non-performance shall not be excused in the event of a service interruption that necessitates the implementation of the Disaster Recovery Plan.

By using the EpiPilot platform, you agree to these Terms and Conditions and acknowledge that you are responsible for ensuring compliance with all applicable laws and regulations in your use of the service. Thank you for choosing EpiPilot as your solution for event and event management.
13. Refund Policy:
EpiPilot does not offer refunds once a billing cycle has started. Cancellation terms depend on the subscription channel:
For purchases made through AWS Marketplace: Customers may cancel their subscription directly from the AWS Marketplace console. The cancellation will become effective at the end of the current contract term (monthly or annual).
For direct purchases through DataWorks: Cancellations must be requested in writing and will take effect at the end of the current billing period, in accordance with the service agreement.
